MAN SEEKS COURT INTERVENTION TO RESTORE MARRIAGE, CLAIMS DIVORCE WAS MADE UNDER DURESS

A businessman based in Kaduna State, Auwal Musa, has filed a case before a Sharia court sitting in Magajin Gari, seeking an order that would compel his ex-wife, Hauwa, to return to their matrimonial home following a divorce he now claims was pronounced under pressure.

Musa, 40, informed the court that he had issued a pronouncement of divorce to his wife, but later reconsidered the decision and attempted to revoke it before the completion of her Islamic waiting period, known as iddah. He told the court that his intention was to reconcile and restore the marriage within the permissible period.

However, according to his testimony, Hauwa declined to return to the marriage despite his attempt at reconciliation, insisting on maintaining the separation.

The businessman is now asking the court to intervene, arguing that the divorce was not given freely but under duress, and therefore should not stand in its current form. He is also urging the court to compel his ex-wife to resume the marital relationship.

The Sharia court in Magajin Gari is expected to review the circumstances surrounding the divorce, including whether it was validly pronounced and whether the attempted revocation falls within acceptable legal and religious provisions. The matter remains under judicial consideration.
