London – The UK government has confirmed plans to launch a review of how courts interpret migrants’ rights, particularly in relation to the European Convention on Human Rights (ECHR).
The move, announced on Tuesday, is aimed at reassessing judicial decisions that have frequently relied on Article 3 (prohibition of torture and inhuman treatment) and Article 8 (right to family and private life) to prevent deportations. Ministers say the review will examine whether such rulings have created barriers to enforcing immigration policy.
Justice Secretary Shabana Mahmood said the government remains committed to its ECHR obligations but argued that the courts’ interpretations sometimes go beyond what was intended. “We need to restore balance between protecting human rights and ensuring the effectiveness of our immigration system,” she said.
The decision comes amid pressure to tighten border controls and accelerate the removal of migrants who have exhausted their legal options. Officials believe greater clarity in judicial guidance could help prevent delays in deportation cases.
However, rights groups and legal experts have expressed concern. They warn that curbing court discretion could undermine vital protections for vulnerable asylum seekers and risk putting the UK at odds with international legal standards.
The review is expected to be completed later this year, after which ministers may introduce legislative changes to guide courts in handling migration-related human rights claims.
