The detained leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, on Friday appeared before the Federal High Court in Abuja for the hearing of his application seeking release from custody amid worsening health concerns.
Kanu, escorted by operatives of the Department of State Services (DSS), arrived in court alongside his legal team led by former Attorney-General of the Federation, Kanu G. Agabi (SAN).
The court had previously rescheduled the matter from October 10 to September 26 to consider his motion, which seeks either outright release or transfer to the National Hospital. His lawyers cited a life-threatening heart condition and argued that medical facilities at the DSS detention centre were inadequate.
During proceedings, counsel for Kanu informed the court that they had only just been served with a 37-page counter-affidavit from the federal government on the morning of the hearing. They requested more time to file a formal response.
Justice Musa Liman, sitting as a vacation judge, expressed doubt over his ability to deliver a ruling within the timeframe, noting that his temporary assignment was ending. He consequently directed that the case file be transmitted to Justice James Omotosho, who is presiding over the substantive trial between Kanu and the federal government.
The development means that a ruling on Kanu’s bid for release remains pending, leaving uncertainty over both his health status and legal fate.
